Sample Rental Agreement

This Disney Vacation Club Point Rental Agreement ("Agreement") is entered into as of the date of electronic signature by and between:

DVC Member ("Member"): [Full Legal Name of Member], a registered owner of Disney Vacation Club ("DVC") points under DVC Membership Number [XXXXXXXX].

Renter ("Renter"): [Full Legal Name of Renter], residing at [Renter Address].

Facilitator: DVC Rental Club facilitates this transaction and manages the escrow payment process. DVC Rental Club is not a party to the reservation and assumes no liability for Disney's performance of resort services.

The Member agrees to use their DVC membership points to book the following reservation on behalf of the Renter:

• Resort: [Disney Vacation Club Resort Name]
• Room Type: [Studio / 1-Bedroom / 2-Bedroom / 3-Bedroom Grand Villa]
• Check-In Date: [Month DD, YYYY]
• Check-Out Date: [Month DD, YYYY]
• Number of Nights: [X]
• Points Required: [XXX] DVC points
• Lead Guest Name: [Name as it should appear on Disney reservation]

The Member shall provide the Renter with a valid Disney confirmation number within five (5) business days of receiving cleared escrow funds, unless circumstances beyond the Member's control prevent booking, in which case a full refund shall be issued.

Total Rental Price: $[TOTAL] USD (the "Rental Price"), calculated at $[XX.XX] per point for [XXX] points.

Escrow: The full Rental Price shall be deposited by the Renter into the third-party escrow account designated by DVC Rental Club within forty-eight (48) hours of both parties executing this Agreement. Funds are not released to the Member until the Renter confirms receipt of a valid Disney confirmation number.

Escrow Release: Upon Renter's verification of the Disney confirmation number, the Renter authorizes escrow release to the Member. If the Renter does not respond to the confirmation within 48 hours of receiving the confirmation number, escrow will be automatically released to the Member.

Facilitator Fee: DVC Rental Club's fee is paid separately by the Renter and is not included in the Rental Price above.

Renter Cancellation: DVC point rentals are non-refundable once the reservation has been made with Disney. The Member commits DVC points to this booking at their own cost. No refunds will be issued for Renter cancellations after reservation confirmation.

Member Cancellation / Failure to Book: If the Member is unable to secure the agreed reservation for any reason within the agreed timeframe, the full Rental Price will be refunded to the Renter from escrow within five (5) business days. The Member bears no additional financial liability in this event.

Disney Cancellation: If Disney cancels or materially modifies the resort or room type such that it no longer meets the specifications in Section 2, the Renter shall receive a full refund regardless of escrow status.

Travel Insurance: DVC Rental Club strongly recommends that Renters purchase comprehensive travel insurance to protect against trip cancellation for personal reasons, medical emergencies, and other covered events.

• Book the reservation specified in Section 2 within five (5) business days of escrow clearance.
• Provide the Renter with a valid Disney confirmation number upon booking.
• Ensure the reservation remains active and unmodified through the Renter's check-out date.
• Not cancel, modify, or reassign the reservation without the Renter's written consent.
• Cooperate with DVC Rental Club to resolve any booking issues in a timely manner.

• Deposit the full Rental Price into escrow within forty-eight (48) hours of agreement execution.
• Verify the Disney confirmation number and authorize escrow release promptly upon receipt.
• Comply with all Disney Vacation Club resort rules and Disney resort policies during the stay.
• Not attempt to sublease, transfer, or sell the reservation to any third party.
• Present valid photo identification matching the lead guest name at resort check-in.
• Accept that the Member's DVC membership governs the terms of the underlying reservation.

DVC Rental Club acts solely as a facilitator and escrow manager. DVC Rental Club is not responsible for resort quality, Disney operations, weather, park closures, or any circumstance affecting the Renter's enjoyment of the stay.

The Member is not liable for changes made by Disney to resort amenities, room categories, or operational policies after the reservation is confirmed. Neither party shall be liable for indirect, incidental, or consequential damages arising from this Agreement.

The total liability of either party under this Agreement shall not exceed the Rental Price set forth in Section 3.

This Agreement shall be governed by and construed in accordance with the laws of the State of [Florida / applicable state], without regard to conflict of law provisions. Any disputes arising under this Agreement shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

By electronically signing this Agreement, both parties acknowledge they have read, understood, and agreed to all terms set forth herein.
